The County Clerk’s office provides these records for free; however, to print copies from the website, you are required to pay using a debit/credit card. A plain copy costs $1.00 per page while certified copies come at a fee of $1.00 per page and $5 for certification.

The County Clerk’s office only certifies their copies. If you provide your copy, the office file-marks it instead.

The Texas Judicial Branch provides an online criminal records search platform called re:SearchTX, where only authorized individuals can search general docket case files.

The Texas Department of Public Safety maintains a Criminal History Conviction Name Search. This online tool provides name-based results for individuals reported to the TX DPS. The public criminal history record details information on the following:

How To Track Down Cass County Probation Records

Most people often confuse probation and parole to the extent of using the terms interchangeably. Probation is a supervised conditional freedom imposed by a court of law. It’s a form of conviction granted to offenders instead of a prison sentence.

The ICOTS is used to track offenders who have been authorized to travel interstate but under supervision. Some of the information on ICOTS is available to the public. Following the following steps to conduct a search:

How To Obtain a Background Check Report in Cass County Texas

There are two types of background checks: personal and professional. People conduct personal background checks, also known as name-based searches, for various personal reasons.

Some of these reasons include:

  • You can conduct a background check on a potential date to protect yourself from potentially meeting a criminal.
  • Background checks can be performed on your babysitter to ensure you do not hire a sex offender.
  • You can run a background check on a person you are associating with at work just to ensure you are not associating with a criminal.
  • If you are an investor, you might conduct a background check on a potential business partner to ensure you are not getting scammed and losing money through your investment.

Anyone can perform background checks on themselves or on another person by searching public records via the agencies listed on this resource. You can also use third-party sites to conduct background checks.

You do not need consent to conduct background checks by searching public records. Additionally, you don’t need to provide a reason for your search. However, the information from these searches should be used according to the law.

The law prohibits using background checks to harass or intimidate others. Inasmuch as this information is available through public records, ensure respect for the privacy of others.

Employers, agencies, and other entities often conduct background checks for various reasons. These include:

  • Employers are known to conduct background checks on potential employees for employment screening.
  •  Landlords and property managers can conduct background checks on potential tenants to check criminal records or even assess their financial history.
  • Some industries are required by law to conduct background checks for purposes such as firearm licensing and even certifications.

Professional background checks are governed by various laws. These include:

  • The Fair Credit Reporting Act (FCRA) provides that a consumer must provide a right of consent before a pre-employment background check can be conducted.8
  • The Equal Employment Opportunity Commission (EEOC) requires that employers not use background checks to deny equal employment opportunities.9

Cass County does not offer a background check process for name-based background checks (level 1) and fingerprint background checks (level 2).

However, you can conduct a Level 1 background check through the Criminal History Conviction Name Search. To access this service, you need to create an account on the site and purchase credits at $3 plus a processing fee.

The Texas Department of Public Safety, through FAST Fingerprinting, has partnered with IdentoGO. The Fingerprint Applicant System of Texas (FAST) provides fingerprint-based searches to authorized individuals and entities for employment and licensing reasons. This search is unavailable to the general public.

The Texas Department of Public Safety also allows individuals (or their authorized representatives) to conduct background checks on themselves. Schedule an appointment online at IdentoGO or call +1.888.467.2080.

Visit any of the DPS FAST locations operated by IdentoGO and have your fingerprints taken. This service costs $10.00 plus a $15.00 fee for the criminal history record information. Results are emailed or mailed to the provided address.

How To View All Criminal Records in Texas via State & Federal Agencies

You can view all criminal records in Texas via various state agencies. Texas provides public records as per the Public Information Act, although the Act does not extend to judicial records.

The Texas Department of Public Safety, through its Crimes Record Division, provides Cass County public records searches for the following:

The Criminal History Conviction Name Search is a search tool through the Computerized Criminal History System.10 It’s a name-based search for offenders who have been reported to the Texas Department of Public Safety (DPS). The TX DPS further provides a Nationwide Sex Offender Registry where individuals can search for information on sex offenders. The first place to look should be the Registered Sex Offenders Map, which offers a visual view of registered sex offenders in the state.

Although not as accurate as fingerprint identification, you can browse the Public Sex Offender Registry Search by entering the following details. You need to sign up for an account to perform this search.

The TX DPS also provides an option to download the Sex Offender Registry at no charge to users. However, this option is only accessible to authorized individuals, and it requires the following details:

Through Vital Statistics, Texas Health and Human Services provides marriage and divorce records for free.16 These records date as far as 1966 and 1968 for marriage and divorce records, respectively.

You can access the marriage and divorce public index via Vital Statistics and view the following details:

Retrieve Cass County Texas Birth & Death Certificates via the County Clerk’s Office

The Cass County Clerk Web Access is the first place to visit for birth and death certificates. To obtain certified copies of your birth certificate, the Web Access search criteria for birth certificates require the subject’s name and date of birth.

The results show whether your search criteria are available. If available, you must log in and add the records to your basket. A fee of $23 is required.

To obtain a copy of a birth certificate other than your own, you must be related to the person whose records you are seeking. The following individuals can access these copies, and ID verification is required to obtain a copy of the death certificate:

The Cass County Clerk also provides an online search for death certificates. Follow the instructions above and search the Death Index.18 The search criteria prompt you to search using the deceased name and date of death.

Through Vital Statistics, the Texas Health and Human Services provides birth and death records, as well as verification of the documents, at a fee.

Copies of birth certificates and verification are charged fees. Also, ensure you meet the mail-in or in-person order requirements.

Using Cass County Public Records Ethically & Understanding Your Rights

Texas public records are made available according to various laws and regulations. As a searcher, you can use government agencies to access public records; however, the use of this information must be in accordance with the law.   3. You have the right to access the information. Some of the information is available for free access. However, there are some instances where you are required to pay processing or shipping fees (or both).

The Texas Public Information Act outlines the rights of the requester as detailed below:

  1. Right to receive the information promptly as long as it is not confidential or protected information.

Under the Fair Credit, employers can use consumer reports to make decisions related to hiring and promotions. In case of job rejection based on the consumer report, the employer must notify the job applicant and furnish them with a copy of the consumer report.

The Employee Polygraph Protection Act prohibits the use of lie detectors by private employers for employment purposes such as screening.
